Course Description

Through concrete examples of law in action, this course will examine how people’s everyday life may be closely related to landmark judicial decisions about the meaning and implications of written laws. This objective will be achieved through students discussing important landmark cases in the English-speaking common law world, which have shaped aspects of citizens’ rights and obligations. The remainder will discuss a range of interpretive issues relating to the judicial application of case-law precedents and statutory provisions. Through a mixture of lectures and smaller group seminars, this course also aims to develop students’ understanding of the character of judicial interpretation and reinterpretation of written legal rules, principles, maxims, and policies. On most topics, law-in-action case studies will be explored to encourage debate on the merits of each decision and alternative possible decisions. The course will also describe and explain the vital role of unpredictable judicial activism and discretion.
